    Enrollment Agreement

    SAT and ACT Course Enrollment Agreement Terms and Conditions

    You have enrolled in an SAT or ACT course with Perfect Score Test Prep, a division of Prowess Test Prep, LLC (“Perfect Score”, "P/S", “we”, “us”, “our”) for the purpose of gaining preparedness for an upcoming SAT or ACT exam. All course methods, strategies, and materials (online and in print) are the exclusive property of Perfect Score Test Prep. You agree not to disclose, reproduce, sell or distribute to any third party any information, written or spoken, including course materials, obtained from us in connection with our courses or other programs. You understand that course size is limited and, therefore, enrollment is filled on a first-come, first-served basis.

    COURSE PAYMENT: You must pay the full amount for the course at the time you enroll (except if you have signed up for our payment plan, in which case payments are due in accordance with such plan).

    DISMISSAL FROM THE PROGRAM: Perfect Score Test Prep may dismiss you from the program if you are on a payment plan and have not paid according to that payment plan or if you, in Perfect Score’s opinion, are disruptive in the course (see our Classroom Decorum paragraph for further details). P/S will not refund any amounts paid by students who are dismissed from a program. In such an extremely rare event, you will not be given any credit or refund, and you will also void our Student-for-Life Promise. None of the benefits of course enrollment, such as discounted rates, will be available to you.

    LOST MATERIALS: If you lose your course materials, you may purchase a replacement set for $35.00.

    COURSE AMENDMENT: From time to time, we will adjust our course work and other classroom material to stay relevant and improve the quality of our services. Furthermore, P/S reserves the right to replace a classroom teacher with another approved P/S teacher at any time and without refund as P/S deems necessary. In such rare events, P/S will try to give advanced notice to the students enrolled in the class for which the teacher will be replaced. We also may need to cancel a course due to low enrollment. In the rare event that this occurs, we will refund the full tuition paid for that course, so long as you have not already attended any sessions from a different course, if using Student-for-life.

    THIRD PARTY WEBSITES AND CONTENT: The Site may contain links to other web sites ("Third Party Sites") as well as articles, photographs, text, graphics, pictures, video, information and other content or items belonging to or originating from third parties (the "Third Party Material"). P/S shall not be responsible for monitoring or checking for accuracy such Third Party Sites and Third Party Material, or access to these Third Party Sites and Third Party Material posted on, available through or installed from the Site. Inclusion of, linking to or permitting the use or installation of any Third Party Site or any Third Party Material does not imply approval or endorsement by Prowess Test Prep, LLC. Users shall be solely responsible should Users wish to leave the Site and access Third Party Sites or to use or rely on any Third Party Material.

    GOVERNING LAW: This Enrollment Agreement and any claim or dispute arising out of, relating to or in connection with this Enrollment Agreement or the transactions contemplated hereby, whether in contract, tort or otherwise, shall be governed by and construed in accordance with the laws of the State of New York without giving effect to its conflicts of law principles.

    PSAT, SAT, SATII, Aspire, ACT, and Other Tutoring Plans Enrollment Agreement Terms and Conditions

    You have purchased a PSAT, SAT, SATII, Aspire, ACT, or Other Tutoring package with Perfect Score Test Prep, a division of Prowess Test Prep, LLC (“Perfect Score”, "P/S", “we”, “us”, “our”) for the purpose of gaining preparedness for an upcoming PSAT, SAT, SATII, Aspire, ACT, or other exam. All course methods, strategies, and materials (online and in print) are the exclusive property of Perfect Score, the subsidiary of Prowess Test Prep. You agree not to disclose, reproduce, sell or distribute to any third party any information, written or spoken, including course materials, obtained from P/S in connection with our courses or other programs. You understand that 1-on-1 tutoring is limited to availability and is based on first-come, first-served. Please note that session lengths are variable; the number of hours you have purchased does not necessarily correspond to the number of sessions you will have if you choose to meet for more than one hour at a time.

    TUTORING TUITION PAYMENT: You must pay the tutoring package amount in full at the time you enroll (except if you have signed up for our payment plan, in which case payments are due in accordance with such plan).

    PAYMENT FOR ADDITIONAL TUTORING HOURS: If you complete more tutoring hours than the number for which you enrolled, you authorize Perfect Score Test Prep to charge your credit card or debit account for the additional hours you have used in accordance with our Tutoring Upgrades policy. Speak regularly with your tutor throughout the tutoring program so you know how many hours you have completed.

    TUTORING UPGRADES: If you’d like to upgrade your existing tutoring package to a package that includes more hours at a greater discount, you may do so prior to the commencement of the third tutoring session, and the amount already paid for the first two sessions will be applied toward the total amount for the new package. After which point in time, you may purchase a new package at the standard package rate and the amount already paid will not be discounted to reflect the new package rate.  If you wish to purchase additional hours, the cost for such hours will be determined according to the number of hours you already purchased. For example, if you bought 9 hours at $135 per hour, the 10th hour up to the 19th hour you purchase will only be $120 per hour to reflect the discounted hourly rate of purchasing ten plus hours. The 20th hour would cost $110 per hour, and so on. But you would not receive a discounted rate for any hours already purchased outside of a tutoring package. In order to get the package rate for hours already purchased, you must request an upgrade prior to the third session.

    CANCELING INDIVIDUAL TUTORING SESSIONS. Students are responsible for notifying the tutor if they will be running late or will need to cancel a scheduled meeting. We respect everyone’s busy schedule, but we ask that you provide this notification to the tutor as early as possible. The first time a student does not notify the tutor that he/she plans to cancel a meeting a minimum of 24 hours prior to the scheduled time for the session to begin will have the option to reschedule without penalty. The second time and all subsequent times thereafter that this occurs, the student will forfeit those hours and will be charged in full the cost of the session missed. If the tutor cancels or misses an appointment without 24 hours advance notice to you, you will receive one free session of equivalent hours to the missed session of tutoring in addition to the hours already purchased in your program. Cancellation of sessions due to inclement weather, hazardous road conditions, or other extenuating circumstances are not included in this policy, see our extenuating circumstances policy. Additionally, students are responsible for scheduling all meetings with their tutors. The tutor is not obligated to meet more than once in any given week but may do so at his/her own discretion. It is the responsibility of the students to coordinate their schedules appropriately to meet the deadline for the exam they plan to take. Tutoring hours are non-transferable, and Perfect Score does not give refunds on any unused tutoring hours outside of our cancellation policy.


    ADULT SUPERVISION: Please note that Perfect Score tutors are not permitted to meet in person with a minor student in a private home unless another adult is present during the entire session. If a tutor arrives for a session and an adult is not present, the tutor will not be able to conduct the session, it will be considered a session cancelled by the student without adequate notice, and you may be charged for the session. If the other adult leaves in the middle of a session with a minor student, the tutor will also leave at that time, and you may be charged for the entire session. Tutors may meet in person with minor students in public locations, such as a library or coffee shop, without another adult present. Meetings at the student’s residence may incur an additional travel charge depending on the distance required for the tutor to travel, see our travel policy.

    TUTOR SATISFACTION: The satisfaction of your tutor is guaranteed. If you are not happy with the tutor selected for you and you notify P/S of this dissatisfaction no later than before your third scheduled session, we will replace that tutor and repeat the session immediately before that replacement at no additional cost. If you are still unhappy with your tutor and notify us before the next scheduled session takes place (after the one for which the replacement tutor was requested), you will be refunded the amount paid for any unused hours (not including the session after which was made the request to have the original tutor replaced) less $75.00 for books and materials. A tutor can be replaced at any time that you feel that he/she is not the right fit for you; however, we will only repeat the session for free once, and you will only be refunded if you deem the replacement tutor is unsatisfactory and notify P/S of this before your third scheduled session. After which time, your tutoring tuition will not be refunded. You may also choose not to be refunded but to have P/S find another replacement tutor so long as one is available in your area.

    In order to receive a refund as set forth above, you must return any program materials you received to us unopened and with no marks in the materials within two weeks of withdrawing your enrollment. Shipping costs for return of materials are at your expense. If you fail to return your program materials within two weeks, or do not return them unopened and unmarked and if you were registered for tutoring, P/S will deduct $75.00 from any refund for which you are eligible.


    DISMISSAL FROM PROGRAM: Perfect Score Test Prep may dismiss you from 1-on-1 tutoring if you are on a payment plan and have not paid according to that payment plan. P/S will not refund any amounts paid by students who are dismissed from a program.

    LOST MATERIALS: If you lose your course materials, you may purchase a replacement set for $35.00.

    POLICIES, TERMS, AND CONDITIONS

    Guarantees, travel, extenuating circumstances, and eligibility restrictions

    PERFECT SCORE’S “FIX IT” GUARANTEE: Students enrolled in our Perfect Score SAT or ACT courses, Small group, Prep 20 or Prep 30 Tutoring Plan, or any other tutoring students who have purchased tutoring packages of more than 20 hours of 1-on-1 tutoring are guaranteed to increase their scores from their established baseline to the next real exam they take after the course has concluded—that’s our Perfect Score’s “Fix It” Guarantee. Basically, if your score does not go up, that’s a problem. And when we see a problem, we fix it. Students eligible for this guarantee, see guarantee eligibility, will be offered  4  hours of tutoring credit (over $500.00 worth of Perfect Score instruction) to use prior to their next scheduled exam of the same type, provided that exam is at least (30) days after that student’s eligibility to use the guarantee has been determined.  If the score still does not go up, P/S will offer an additional 4 hours of tutoring credit under the same conditions and restrictions as the first 4 hours and will continue to do so under these conditions and in accordance with all terms and conditions until the student has taken his/her last exam of that type or until the student has graduated his/her senior year. The bottom line is that we want to see you succeed, and we will keep trying so long as the opportunity to do so remains available to us. P/S does not offer a money back guarantee. Why? A money back guarantee does not fix the problem or help you get into your top-choice college. Furthermore, it leaves you feeling dissatisfied. We want all of our students to be happy with their decision to work with us. In the unlikely event that a student’s scores do not increase from their baseline score on their next real exam, the tutor assigned for the credit hours may be either the same tutor the student worked with previously or a new tutor based on P/S’s discretion.

    PERFECT SCORE’S “STUDENT-FOR-LIFE” PROMISE (“Course Sit-Ins”): Once enrolled in a participating program, P/S students are invited to attend any Corporate Woods Perfect Score SAT or ACT class any time so long as the class they plan to attend is not full at the time of enrollment—we call this our “Student-for-Life” Promise. If you missed a class, forgotten something, or just want to take the class again, you are welcome. Eligibility for this is restricted to students who officially enroll in one of our Perfect Score Course Unlimited plans or our 30-or-more-hour Tutoring Packages and is available until the student takes his/her last exam senior year of high school. Course “Sit Ins” are subject to seating and availability and are on a first-come, first-served basis. While students may come to any session for which they are eligible, see eligibility restrictions, without giving advanced notice of any kind to the instructor of that course, we request that you do give notice that way we can guarantee your seating.


    ELIGIBILITY: In order to be “eligible” for Perfect Score’s “Fix It” Guarantee, a student must have demonstrated a commitment to achieving a higher score. For our Perfect Score SAT or ACT courses-, SAT or ACT Prep 20 or Prep 30 Tutoring Plans-, certain Small Group Tutoring Labs (where specified)-, or tutoring packages of more than 20 hours of 1-on-1 tutoring-students, Perfect Score defines “commitment” as the actions of…


    (i) fully attending all course sessions (or following the make-up procedures to complete any missed course sessions)


    (ii) completing all course homework as assigned in the course binder


    (iii) completing in full (at home or on-site) all course practice tests offered throughout the course.


    Items (i – iii) must be completed and checked off by your instructor no later than (2) days prior to the date you are scheduled to take your next exam.


    Showing up more than (30) minutes after a lesson has begun (there are 2 lessons to each session - check the schedule to be sure you are attending the lesson you planned to attend) will not count as full attendance for that session and a make-up for the amount of time missed will be required. We are committed to helping you. We ask that you be committed to helping yourself.


    “Score increase” is defined as any amount higher than the established baseline score for that student. P/S determines a student’s baseline score to be any documented score earned previous to utilizing P/S’s services. Such scores may be obtained in three ways:


    1. through a student submitting documentation of scores from a previous “real” (official) SAT or ACT exam


    2. through a student submitting documentation of scores from a previous “real” (official) PSAT or Aspire exam and Perfect Score providing the appropriate SAT or ACT score equivalence


    3. through taking one of P/S’s SAT or ACT Diagnostic Exams, provided the exam is taken in a proctored setting with a P/S instructor or at one of P/S’s offices. Or your results have otherwise been deemed acceptable for the guarantee by a PS instructor.

    MAKE-UP PROCEDURES: If you know you are going to miss a class, you should notify the instructor in advance to arrange a make-up. To continue to be eligible for the P/S's “Fix it” Guarantee, you are obligated to make up any missed classes. You may choose from 2 options:

     

    (1) If you are registered for our Perfect Score Course Unlimited plan, you may “sit in” on a different course, if one is available, for the same class you missed; or

     

    (2) you may purchase individual tutoring hours at the current base tutoring rate for individual hours to make up the hours missed. A minimum of 2 hours of 1-on-1 tutoring is required to make up any 1 missed session.

     

    Perfect Score’s “Fix It” Guarantee is only available for the course in which you have officially enrolled (as indicated on your enrollment form). P/S will not offer make-up-session discounts for any missed sessions in a class that is not the class for which you are officially enrolled. In the event that you miss a class, you will still be responsible for all binder work and homework assigned to students during the session you missed in order to remain eligible for P/S’s guarantee. Your instructor will check to make sure that these requirements are met.

     

    Failure to achieve the requirements of an established baseline score will result in being ineligible to receive Perfect Score’s “Fix It” Guarantee.

    Guarantees and course enrollments are non-transferable.




    EXTENUATING CIRCUMSTANCES TO CANCELLATIONS


    ILLNESS OR INJURY: In such extenuating circumstances as extended illness, death, impairment of ability, or moving from the state, if a tutor can no longer meet with a student and no replacement for that tutor can be made, or P/S deems it necessary to cancel tutoring services for reasons other than a breach of contract by the student, P/S will reimburse its students the amount paid for any unused tuition or tutoring hours.


    WEATHER: Occasionally, classes or individual tutoring sessions may need to be cancelled due to inclement weather or unsafe road conditions. In such extreme cases, P/S’s determination to cancel a class will be made as follows: if the State University of New York at Albany (“University”) has cancelled evening classes, P/S will cancel its classes. You can find out about University cancellations due to inclement weather via your T.V. on local news stations or by visiting the University website at Albany.edu. If the University has not cancelled, assume P/S classes will not be cancelled, unless otherwise notified.


    For all 1-on-1 tutoring sessions, the tutor will notify the student via e-mail or by phone call of any cancellation due to inclement weather. We are always concerned for the safety of our students; if you think it is unsafe to drive, please e-mail your tutor as early as possible to cancel. You will not be penalized for such cancellation, so long as you give notice and the need to cancel is justified.


    TRAVEL: Perfect Score tutors operate in and around Albany, NY within a 10-mile radius of its headquarters at 18 Corporate Woods Blvd., Albany, NY 12203. A $35.00 additional charge per session for traveling will be assessed if the tutor is requested to travel outside this radius up to 15 miles and a $75.00 additional charge will be assessed per session if the tutor is requested to travel outside a 15-mile radius up to a 25-mile radius from these headquarters.


    To avoid travel charges, we will try to match you with a tutor close to the area where you request the tutoring take place whenever such a tutor is available. We will also offer other convenient meeting locations, if that is preferable. While our tutors will make a strong effort to meet their students at the student’s home, we cannot always accommodate this. Ultimately, the meeting place will be one agreed upon by the student and the tutor prior to that session taking place.


    A tutor may choose not to meet at the student’s home if the home is deemed “unfit” for learning, and such a decision is at the tutor’s discretion..


    Classroom Decorum: Students are expected to be fair to the teacher and fair to one another. Every student has the right to learn and to be part of a distraction-free environment. We expect our students to silence cell phones and pagers during class, to keep video game systems and other distracting electronics out of the classroom, and to keep idle chatter to a minimum so that lessons can run smoothly for the benefit of all. Abuse toward a Perfect Score instructor in any way will not be tolerated and will be grounds for a non-refundable dismissal from the program. Excessive misconduct will not be tolerated and will be grounds for a non-refundable dismissal from the program.


    The above agreements along with terms and conditions were amended 5/15/2017.


    P/S reserves the right to amend or abolish this policy at its own discretion. Such amendments to our policies will be highlighted for your convenience along with the date the amendment was applied. We encourage you to visit our policies page frequently to stay up-to-date on such changes.

     

     

     

    Privacy

     

     

    SOLICITATION AGREEMENT: By becoming a customer of Perfect Score Test Prep, you agree that you will not solicit for employment, hire, or engage as an independent contractor, or permit any organization directly or indirectly controlled by you to solicit for employment, hire, or engage as an independent contractor, any person employed by Prowess Test Prep LLC at any time during and up to (10) months after the period in which our services have been rendered to you. If you would like to hire one of our P/S teachers for any of the same services related to those provided by Prowess Test Prep LLC, and its subsidiary Perfect Score Test Prep, you must obtain explicit approval for these services by calling 1-518-364-7908 and speaking with one of us directly.

    GOVERNING LAW: This Privacy Policy and any claim or dispute arising out of, relating to or in connection with this Privacy Policy or the transactions contemplated hereby, whether in contract, tort or otherwise, shall be governed by and construed in accordance with the laws of the State of New York without giving effect to its conflicts of law principles.
